لا شك بأن حماية البيئة أثناء النزاعات المسلحة تعد من أهم الموضوعات التي تؤثر في مصالح المجتمع الدولي، وتمس القيم الإنسانية العليا، كون البيئة تمثل وجود الإنسان وكل ما يتعلق به من حاجات الهواء والماء والغذاء وغير ذلك من ضرورات حق الإنسان بالعيش الكريم.
وقد كفل القانون الدولي الإنساني الحماية للمدنيين أثناء النزاعات المسلحة، وإذا كان المدنيون جديرين بالحماية، فإن الحماية تكون حتمية للبيئة، وسط الدمار والضياع لا سيما في ظل تزايد عدد النزاعات المسلحة بشكل كبير، الأمر الذي يستوجب إضفاء قدر من مقتضيات الإنسانية لمواجهة هذه المشلكة، وإيجاد حلول عملية يمكن أن تكفل حماية أفضل للبيئة من آثار النزاعات المسلحة.
بالإضافة إلى ذلك إن ما تعرضت له البيئة العراقية جراء النزاعات المسلحة، وما تركته هذه النزاعات من آثار وخيمة على البيئة. أعطى لموضوع هذه الدراسة أهمية كبيرة، بغية بيان الأسانيد القانونية التي يمكن من خلالها للعراق تحميل الدول التي الحقت ضرراً ببيئته المسؤولية الدولية بشقيها المدني والجنائي.
لذلك عمد المؤلف إلى تناول موضوع "الحماية الدولية للبيئة أثناء النزاعات المسلحة" في مبحث تمهيدي وثلاثة فصول:
أما الفصل الأول فعرض فيه مصادر الحماية الدولية للبيئة أثناء النزاعات المسلحة.
أما الفصل الثاني فتناول فيه الحماية الدولية للبيئة في ظل منظمة الأمم المتحدة، واللجنة الدولية للصليب الأحمر.
أما الفصل الثالث فخصصه لموضوع المسؤولية الدولية عن الأضرار البيئية أثناء النزاعات المسلحة، والتي تعد العنصر الأساسي، والسمة البارزة في أي نظام قانوني، حيث بموجبها يتم كفالة احترام النظام القانوني. لذلك عمد المؤلّف إلى تناول موضوع "الحماية الدولية للبيئة أثناء النزاعات المسلّحة".
