يتطرق موضوع هذه الرسالة إلى المسؤولية القانونية عن انتهاك القواعد القانونية والدولية الخاصة بحماية الأطفال والنساء، وخصوصاً تلك المتعلقة بتجنيدهم أو استخدامهم الفعلي في العمليات العدائية؟ وهل يقتصر الأمر على مسؤولية الدولة التي انتهكت هذه الإلتزامات، أم أن الأمر يتعدى ذلك إلى تقرير المسؤولية الجنائية الفردية للأشخاص المتورطين في مثل هذه الإنتهاكات؟ وما هو موقف المحاكم الجنائية الدولية وموقف اللجان والمنظمات من هذه الممارسات؟
إن هدف هذه الدراسة يرمي إلى البحث عن مدى فاعلية الحماية التي يكفلها القانون الدولي الإنساني لفئة الأطفال والنساء وأساليبها إزاء مجمل ما تواجهه هذه الفئات من مصاعب في حالة النزاعات المسلحة، إضافة إلى الحقوق الإضافية التي تم تقريرها لفئة الأطفال والنساء لتوفير الحماية الخاصة لهم، وإضافة لذلك إلى بحث سبل حماية الأطفال والنساء من مسألة تجنيدهم في العمليات العسكرية لأطراف النزاع، وتسليط الضوء على الإنتهاكات التي تمارس ضد الأطفال والنساء أثناء النزاعات المسلحة، والبحث في الدور الذي تقوم به الهيئات والمنظمات واللجان الدولية في توفير حماية كاملة للأطفال والنساء في حالة النزاعات المسلحة.
وتهدف هذه الدراسة أيضاً إلى بيان مدى الحاجة الماسة لتطوير وتفعيل القواعد المتعلقة بحماية الأطفال والنساء في حالة النزاعات المسلحة بشكل ينسجم مع التطورات الدولية الحديثة للنزاعات التي تؤمن الحماية الكافية للأطفال والنساء.
