إن واقعة قبض الأموال واستيفائها فيما يبرمه الناس بينهم من معاقدات إنما هي ثمرة عقودهم وغايتها ومقصودها، ولا شك أنه يترتب على القبض في العقود أثار هامة ونتائج خطيرة ومباحث عميقة تحتاج إلى بسط وتجلية وبيان، خصوصا ما يتصل بالقبض الحكمي فيها، وقد بسط هذا الكتاب القول في ذلك، فبين فيه مؤلفه حقيقة القبض وأنواعه، وأركان وشروط القبض الحكمي، وصور تحققه في المنقولات بأنواعها المختلفة، وصوره في الديون، كاقتضاء أحد النقدين من الآخر، وتطارح الدينين صرفا، والمقاصة بين الدينين، والإسلام بالدين الثابت في الذمة، وحكم بيع الدين لمن عليه الدين ولغيره، وحكم رهن الدين، وحوالته وهبته، كما اشتمل الكتاب على وقت انتقال الضمان إلى المشتري، وحكم بيع المبيع قبل قبضه، وحقيقة المنفعة وتكييفها، وكيفية قبض المنافع في الإجارة، وحكم إجارة المشاع، وحكم إجارة المنافع بالمنافع، وحكم إيجار المستأجر العين المستأجرة، وحكم القبض السابق ومدى قيامه مقام القبض اللاحق، وحكم قبض الأموال الشائعة والمشغولة، ثم ذيل الكتاب بالتطبيقات الفقهية المعاصرة للقبض الحكمي، كالشيك ومدى قيامه مقام القبض، وبطاقات المعاملات المالية، والأسهم، والقيد المصرفي.
