لقد اعتنى الإسلام بالأسرة عناية شديدة منذ أن تكون خاطرة لدى الإنسان، وإلى أن تتكون، بل وإلى أن تنتهي، إما نهاية طبيعية، وإما غير طبيعية وهو ما يعبر عنه بفرق النكاح. ولا شك في أهمية هذه الدراسة؛ فقد كثر السؤال عنها في عصرنا، نظرا لما نشاهده من جهل بأحكام الأسرة وخاصة ما يتعلق بالطلاق، الأمر الذي يؤثر بالسلب على امتدادها وفق المنهج الرباني.
وقد بسط المؤلف الحديث في هذا الكتاب عن تعريف الطلاق، وحكمه، وحكمة مشروعيته، وأنواعه وحكم كل نوع، وصريح الطلاق وكناياته، وأركان الطلاق وشروطه، وحكم طلاق السكران والمكرَه والغضبان والمدهوش، كما بسط الحديث عن محل الطلاق والولاية عليه، وكذا ما يتعلق بالتنجيز والتعليق في الطلاق، وأعقب ذلك بالكلام عن الطلاق الرجعي والبائن بقسميه، وحكم طلاق المريض وكذا أحكام التفويض في الطلاق، ثم جاءت الدراسة بالكلام عن الخلع وصفته وحكمه وحكمة مشروعيته وألفاظه وأركانه وشروطه، وحكم خلع المريضة مرض الموت، وشروط عوض الخلع، ثم ختمت الدراسة فيه بالآثار المترتبة عليه، وتلت هذه الدراسة الفرق بين الزوجين بواسطة القاضي وأسبابها وأنواعها، فذكر الباحث التفريق لعدم الإنفاق، والتفريق بالعيب، والتفريق للغيبة، والتفريق للشقاق، والتفريق بالإيلاء، والتفريق باللعان، وأخيرا ختم الباحث كتابه بالحديث عن العدة وحكمة مشروعيتها وأنواعها.
