مما هو معلوم أن الله سبحانه وتعالى قد أمر برد الحقوق إلى أصحابها، وعدم المماطلة في ذلك، وشدد سبحانه على ضرورة إعطاء كل ذي حق حقه، غير ان بعض النفوس الضعيفة لا تستجيب لذلك، فأنكرت الحقوق، وخانت الأمانة، وجحدت الدين ... في الوقت الذي لا يجد صاحب الحق معه ما يثبت به حقه.
وقد جاءت هذه الدراسة لبيان أن للإنسان طرقا أخرى غير طريق القضاء ليصل به إلى حقه، وهو المسمى بطريق اقتصاص المرء حق نفسه، أو ما يعرف بالظفر بالحق، وقد بسط فيه مؤلفه بيان ماهية هذا الطريق وأحكامه وضوابطه، ونوعية الحق الذي يندرج تحته، وقد شملت الدراسة حقيقة الظفر بالحق وعلاقته بالاستيفاء والاستيلاء، والحقوق التي يجوز استيفاؤها بغير قضاء، والحقوق التي لا يجوز استيفاؤها إلا بالقضاء، والحقوق المختلف فيها، ثم ذيل ذلك بشروط بمسائل متفرقة وشروط إعمال طريق الظفر بالحق.
