عقد السمسرة من العقود غير المسماة التي لم تقر لها الشريعة أحكاماً خاصة تميزها عن غيرها من العقود، لذا اختلف الفقهاء المحدثون في أحكام وآثار هذا العقد تبعاً لاختلافهم في تكييفه، هل هو عقد إجارة فتنطبق عليه أحكام عقد الإجارة، أم عقد جعالة فتنطبق عليه أحكام عقد الجعالة، أم عقد وكالة فتنطبق عليه أحكام عقد الوكالة؟ هذه التساؤلات وغيرها تحتاج إلى دراسة جادة لبيان مدى مشروعية عقد السمسرة وتكييفه الشرعي والقانوني، وما يترتب على ذلك من أحكام شرعية وآثار قانونية وتطبيقية. وسوف أقوم فى هذا البحث بدراسة عقد السمسرة بشكل يحدد جوانبه الشرعية والإقتصادية و القانونية فى ضوء التطبيق المعاصر.
