هذا العلم العظيم الذي يحقق الخير لسالكه قسمه العاملون فيه والمتبحرون في أعماقه من فقهائنا الأفاضل إلى فروع وأقسام، تتمثل في العبادات، والمعاوضات التي تشمل المعاملات المالية وأحكام أحوال الشـخصية، والأحكام السلطانية، وأحكام الجهاد وهي ما يطلق عليه الآن ’الحقوق الدولية‘، والعقوبات المتمثلة في الحـدود والقصـاص والتعزيرات، والمرافعات الشاملة للدعاوى وطرق الإثبات وطرق القضاء، والأحكام المتعلقة بالأخلاق والحشمة، والتي تسمى بالآداب.
والبحث الذي بين أيدينا يندرج ضـمن المعامـلات، التي قوامها العقود، والتصرفات التي ترمي في جملتها إلى إشـباع رغبات الناس المتنوعـة، وتحقق مصالحهم، واستقرار سبل التعامل فيما بينهم...وإن من شأن هذه العقود من بيع وإجارة وصلح ونكاح ونحوها، أن تكون ملزمة لعاقديها امتثالاً لقوله تعالى: ﴿ أَيُّهَا الَّذِينَ آمَنُواْ أَوْفُواْ بِالْعُقُودِ ﴾[المائدة: 1].
فهذه الآية الكريمة صريحة الدلالة في وجوب الالتزام التعاقدي الذي يتمثل في التعهد الضـمني باحترام آثار العقد والوفاء بالتزاماته بمجرد انعقاده صـحيحاً، ولكن قد يتراخى هذا الالتزام المنصوص على وجوبه نتيجة عارض يطرأ على العقد، فيفقده قوة الإلزام، وعندئذ يملك أحد العاقدين أو كلاهما فسخ العقد، وهو موضوع هذه الأطروحة التي حاولت فيها أن أتناوله بشكل نظرية متكاملة واضحة المعالم، بينة الأركان والأسس، توضح مفهومه وتحدد أحكامه وتربط فروعه بأصوله، ومسائله الجزئية بأمهاتها الكلية.
