من المعلوم أن قانون العقوبات هو: مجموعة القواعد القانونية التي تحدد ما يعتبر من صور السلوك الإنساني جرائم وما يترتب على اقترافها من جزاءات، وينقسم إلى قسمين: قسم عام وقسم خاص.
وهذا الكتاب بقسميه الأول والثاني يبحث في جرائم العدوان على المصلحة العامة [القسم الخاص] ، أي يمكن اعتباره دراسة تحليلية للنصوص المقررة لهذه الجرائم في قانون العقوبات المصري تهدف إلى بسط الأحكام التفصيلية التي تضمنتها تلك النصوص في ضوء آراء الفقه وأحكام القضاء في مصر.
من هذا المنطلق جاءت هذه الدراسة بمثابة نقد لتلك النصوص بهدف الوقوف على مدى كفاية هذه النصوص القائمة على تحقيق الغاية منها ثم بيان أوجه النقص والقصور فيها واقتراح الحلول التي من شأنها مواجهة هذا النقص والقصور، ويستند الكاتب هنا إلى التشريع وأحكام القضاء وآراء الفقه في فرنسا وغيرها من الدول بالقدر الذي تقتضيه الدراسة النقدية لنصول قانون العقوبات المصري في خصوص الجرائم المضرة بالمصلحة العمومية.
ونظراً لأهمية هذه الجرائم موضوع البحث يتعرض الكاتب إلى نماذج منها تم اختيارها بالنظر إلى اعتبارات متعددة، ومنها أهمية الحق أو المصلحة محل الحماية الجنائية، ودقة المشاكل القانونية التي يثيرها تطبيقها العملي، ومدى تكرار وقوعها في الحياة العملية.
لأجل ذلك يقسم الكاتب دراسته هذه في [القسم الأول] إلى أربعة أبواب على النحو التالي: الباب الأول ويبحث في جرائم الرشوة، الباب الثاني ويبحث في جرائم العدوان على المال العام. أما الباب الثالث فيبحث في جرائم تزوير وتقليد الأختام والعلامات وما شابهها. ويأتي الباب الرابع ليبحث في جرائم التزوير في المحررات العرفية – والمحرر العرفي هو كل محرر لا يصدق عليه وصف المحرر الرسمي – والمحررات هي العقود العرفية وسندات المديونية ... الخ.
أما [القسم الثاني] فيبحث في ثلاثة أبواب هي: السرقة، النصب، خيانة الأمانة.
تأتي أهمية هذا الكتاب من كونه يلقي الأضواء على قضية هامة تفوق أهميتها الجرائم المضرة بالأفراد، حيث أنها تصيب بالضرر أو تعرض للخطر مصالح المجتمع على نحو مباشر، وضررها الإجتماعي في الغالب جسيم. فهي قد تهدد كيان الدولة ذاته، أو تنزع الإستقرار السياسي والسلام الإجتماعي فيها، أو تخلّ بالثقة العامة في مؤسسات الدولة ونظمها الإدارية أو الإقتصادية أو المالية ... وهذه المسائل هي ما بحثت فيه هذه الدراسة الشاملة لعموم القضايا الآنفة الذكر.
