إن المساس بالحياة الخاصة للعامل يحدث بصورة أو بأخرى سواء عند التعاقد أو بعده، فحينما يتقدم العامل إلى صاحب العمل بغية التعاقد معه والعمل لديه، يقوم الأخير بالبحث والتحرى عن العامل بهدف اختيار أنسب العناصر البشرية التي ستعمل بمشروعه، وقد يدفع بالبحث إلى مدى أبعد فيصيب بقعة الحياة الخاصة للمرشح للعمل وينبش في أسرارها ويطال خصوصياتها مستغلاً ضعف المتقدم وحاجته إلى الوظيفة، وهو الأمر الذي يشكل انتهاكاً للحق في الخصوصية، ويجد صاحب العمل حجة أخرى أثناء تنفيذ العقد وهي مراقبة تنفيذ العامل للعمل وحسن إدارة المشروع.
هذه المسائل وغيرها دفعتنا إلى تناول هذا الموضوع محاولين سبر أغواره والتعرف على جوانبه المختلفة بغية رسم الحدود، والبحث عن الضمانات التي تفصل بين حق العمل في إدارة مشروعه وحق العامل في الحفاظ على حياته الخاصة بعيداً عن تدخل صاحب العمل.
وسوف نعالج جوانب هذا الموضوع من خلال فصلين أساسين نتناول في أولهما حماية الحياة الخاصة للمتقدم للعمل في مرحلة ما قبل التعاقد، ونتناول في الثاني حماية الحياة الخاصة للعامل أثناء تنفيذ العقد، وسيكون من الملائم التعرف على مدلول الحياة الخاصة ومدى سلطة صاحب العمل في المساس بها من خلال مبحث تمهيدي يتصدر هذا البحث.
