إذا كانت القاعدة القانونية قد وضعت لتحقيق المساواة بين الأفراد بطريقة عامة ومجردة دون مراعاة لظروفهم الاقتصادية أو لمكانتهم الاجتماعية فإن ذلك يؤدي، في الواقع، إلي ترجيح كفة الميزان لصالح الأقوي اقتصادياً أو اجتماعياً، وهو الأمر الذي جعل قانون العمل ينظم العلاقات الإنسانية بأسلوب خاص وطريقة مبتكرة بقصد حماية العامل، وهو الطرف الضعيف في العلاقة العقدية، خاصة في ظل التطورات الاجتماعية والتحولات الاقتصادية والتوجهات نحو الخصخصة وحرية رأس المال.
وإذا كان المشرع يهدف من وراء اسباغ الصفة الأمرة إلي حماية العامل، وهو الطرف الضعيف، بضمان حد أدني لحقوقه لا يجوز النزول عنه، فإن هذا الهدف قد يتحقق علي نحو أفضل من خلال الشروط أو الاتفاقات التي تزيد عن الحد الأدني او تقرر مزايا أفضل للعامل.
ومعني ذلك أن الشرط الذي يخالف قواعد قانون العمل يغدو باطلاً ما لم يكن أكثر فائدة للعامل من حكم القانون فإنه يصح وتكون له أولوية في التطبيق علي حكم القانون.
فما هو مدلول الشرط الأفضل للعامل وما هي انعكاساته علي النظام العام، وما هي المعايير المتبعة للمفاضلة وما هو النطاق الحقيقي الذي يحتله من الناحية العملية، وما هو دور القاضي في إعمال وتطبيق الشرط الأفضل؟.
تلك هي التساؤلات التي سوف نسعي جاهدين للبحث فيها، سواء علي الصعيد الفقهي أو القضائي، وذلك في كل من فرنسا ومصر وممكلة البحرين، خاصة في ظل توجه المشرع إلي توسيع دور القطاع الخاص وتفعيل عقود العمل الجماعية من خلال قانون العمل رقم 12 لسنة 2003 في مصر، وقانون النقابات العمالية رقم 33 لسنة 2002 في مملكة البحرين مما سيكون له مردوده علي حماية العمال من خلال الشروط الأفضل للعمال التي يمكن أن تسعي النقابات لإدراجها في عقود العمل الجماعية.
