وإذا كانت الأمانة والإخلاص تمثل مظهراً من مظاهر الجانب الأخلاقي للقاعدة القانونية عموماً إلا أنها- وبحق- تعد مرتكزاً أساسياً يقوم عليه البناء العقدي في علاقات العمل ليس فقط عند نشوء العلاقة العقدية بل أيضاً لاستمرارها وبقائها.
ومن هنا تبدو فكرة البحث وأهميته، حينما يستند صاحب العمل إلي إخلال العامل بالتزامه بالأمانة والإخلاص كوسيلة لإنهاء علاقة العمل، فيثور التساؤل حول حقيقة الالتزام بالأمانة والإخلاص في علاقات العمل ومدي الضرر الذي يصيب المشروع جراء مخالفة العامل لالتزامه بالأمانة والإخلاص ذلك الالتزام الذي يعم ويكتنف سائر التزامات العامل بأسرها.
فعلي حين قد تستوجب المخالفة البسيطة توقيع جزاء تأديبي بسيط في بعض الأحوال، يقتضى الأمر إنهاء العلاقة العقدية كلية في أحوال أخري، سيما في تلك المشروعات التي لا تطالب العامل بمجرد الأمانة الإخلاص فحسب بل وبالولاء الكامل لمبادئها وأعرافها وأهدافها، وهو الأمر الذي يطرح فكرة التناقض بين مصلحة المشروع وبين حرية العامل وحقوقه الشخصية التي تكفلها نصوص الدساتير والقوانين المختلفة.
وعلي هذا الأساس سوف نمهد لهذا البحث بالتعرف علي الأمانة والإخلاص كمفهوم خلقي في العلاقات العقدية، ثم نعرض في فصل أول للالتزام بالأمانة والإخلاص في المرحلة السابقة علي عقد العمل، أما المرحلة اللاحقة علي إبرام عقد العمل فستكون محلاً للدراسة في الفصل الثاني.
ومن الجدير بالذكر أن هذا البحث المتواضع انتهى العمل فيه قبل نهاية عام 2002 ثم صدر في أبريل 2003 قانون العمل الجديد رقم 12 لسنة 2003، فرأينا أن من الأمانة والإخلاص الإشارة في ثنايا البحث إلي القانون الجديد كلما كان ذلك ممكناً.
