Book Description
قانون العقوبات فرع من فروع النظام القانوني للدولة. وهو مرادف لمصطلحي القانون الجزائي والقانون الجنائي. وتعدد هذه التسميات لا يعني اختلافاً في مضامين كل منها بقدر ما يمثل ممارسة فقهية لفن التأصيل لا أكثر. وربما يكون للقانون الجزائي (أو الجنائي) مفهوم أوسع من قانون العقوبات.
ويمكن تعريف القانون الجزائي بأنه "فرع من فروع النظام القانوني الداخلي تمارس الدولة بمقتضاه سلطتها في التجريم والعقاب من الناحية الموضوعية والإجرائية. فتحدد من الناحية الموضوعية الأفعال المعتبرة جرائم وتنص على الجزاءات المقررة لها، كما تنظم من الناحية الإجرائية وسائل ملاحقة المتهمين بارتكاب هذه الجرائم، والتحقيق معهم، ومحاكمتهم بواسطة الدعوى العمومية".
وما يسعى هذا الكتاب لتقديمه هو تقديم دراسة تعني بشرح مفهوم مصطلح قانون العقوبات وتبيان ماهية هذا القانون ونطاق تطبيقه، ولدراسة ماهية الجريمة وتقسيماتها، والبناء القانون للجريمة والصور الخاصة بها، وأخيراً سعت الدراسة لبيان موانع المسؤولية الجزائية، وللحديث عن الجزاء الجنائي ماهيته وصوره ونطاق تطبيقه.
