إن قيام المجرم بارتكاب جريمة ينشئ للمجتمع حقاً في مجازاته، لكن هذا الحق لا يجوز تنفيذه عليه تلقائياً، وبصورة آلية لمجرد ارتكابه الجريمة. فالقاتل المتعمد لا يصار إلى إعدامه فور القبض عليه، والسارق لا يعاقب بمجرد اختلاسه للمال، بل لا بد لتنفيذ الجزاءات التي ينص عليها قانون العقوبات من اتباع الإجراءات التي وضعها قانون الأصول الجزائية لملاحقة الجرائم.
من هنا تأتي أهمية هذا القانون الأخير، باعتباره الأداة التي تنقل الجزاء الوارد نظرياً في قانون العقوبات إلى حيّز التنفيذ الواقعي الملموس. والواقع، أن وجود قانون للعقوبات لوحده لا يكفي لتحقيق أهداف السياسة الجزائية للمجتمع، بل لا بد من وجود قانون آخر لإجراء المحاكمة الجزائية بحيث يتيح ضبط الجريمة وكشف فاعلها، وإعطاء الحق للقضاء في مجازاته. ففاعلية الجزاء لا تقاس بمقدار الخشية من شدة العقوبات المنصوص عليها، وإنما تقاس بمقدار تأكد المجرمين من عدم تمكنهم من الإفلات من الجزاء، الوجود قانون للإجراءات الجزائية يلاحقهم عن جرائمهم.
في هذا الإطار وجدل قانون الإجراءات الجزائية يأتي هذا الكتاب الذي يتضمن النظرية العامة التي تحكم جميع إجراءات هذا القانون، والتي لا غنى عنها لمعرفة أهميته، ومبدأ المشروعية الذي ينطلق منه، وماهية قواعده ومصادره، ومنهج تفسيره وموقعه من الأنظمة الإجرائية العالمية، وأقسامه العامة وإصداره ونفاذه. كما ألحق في خاتمته الأسباب الموجبة له، وتقارير لجنة الإدارة والعدل، ومرسوم رده وإعادة النظر فيه، وقانون تعديله، وأخيراً نسخة القانون في صورته المعدلة. ويحدو المؤلفان الأمل في متابعة هذا العمل بكتاب يحمل عنوان (قانون أصول المحاكمات الجزائية معلقاً عليه بالفقه وأحكام القضايا).
