إن دراسة جوهر القانون هي دراسة في فلسفة القانون، وبالتالي دراسة في الفلسفة بصفة عامة. ولذلك فإن الفلاسفة وحدهم هم الذين يقومون بوضع النظريات الخاصة بجوهر القانون، دون أن يشاركهم في ذلك رجال القانون من غير الفلاسفة. وبالنسبة لهؤلاء فإن دورهم يقتصر علي متابعة وتسجيل ما يصدر عن الفلاسفة دون القيام في هذا الشأن بأي دور خلاق. وأقصي ما يمكن أن يصل إليه رجل القانون غير الفليسوف هو الترجيح بين الفلسفات المختلفة والانحياز لواحدة منها أو ضد واحدة منها.
ومن المتصور بطبيعة الحال أن يصل رجل القانون إلي درجة الفلسفة، فيصبح فليسوفاً ورجل قانون في نفس الوقت. ولكن سواء وصل إلي هذه الدرجة أم لم يصل، فلا غني له عن فلسفة القانون، إذ بدونها يظل عاجزاً عن الوصول إلي الأبعاد الحقيقية للقواعد التي يقوم بدراستها أو تفسيرها أو تطبيقها، بل يظل عاجزاً عن أن يخطو الخطوة الأولي في هذا الطريق.
ولهذا السبب ذاته فإن المدخل إلي دراسة القانون لا يمكن اجتيازه إلا عن طريق الاهتمام بموضوعات فلسفة القانون.
وهكذا فإن فلسفة القانون يدرسها طالب القانون قبل أن يدرس غيرها، فهي بداية المبتدئ. وكذلك يدرسها رجل القانون بعد أن يتم نضجه، فهي أيضاً نهاية المجتهد.
علي أنه مع اهتمامنا بدراسة جوهر القانون، فسنعطي اهتماما أكبر لدراسة صياغة القانون.
وتنقسم دراستنا للنظرية العامة للقانون إلي الأبواب الأربعة الآتية: (قواعد القانون، جوهر القانون، مصادر القانون، تطبيق القانون).
