تتسم نظرية السبب في الواقع بقدر كبير من الغموض والتعقيد, ويرجع السبب في ذلك إلى عدم وضوح فكرة السبب بالقدر الكافي, ووجود جدل شديد بين الفقهاء حول جدواها بل ووجودها نفسه.
ولعل السبب في صعوبة هذه الفكرة أيضاً يرجع إلى أن المتعاقد عندما يبرم العقد تكون هناك أمور نفسية أو ذاتية كثيرة تختمر في ذهنه, وخيارات عديدة يفاضل بينها. والمشكلة هنا تكمن في صعوبة تحقيق المساواة بين السبب باعتباره تمثل لغاية أو غرض في نفس المتعاقد, وبين العناصر التي يحققها العقد من الناحية الواقعية أو الفعلية.
سوف نقسم هذه الدراسة عن نظرية السبب والعدالة العقدية إلى فصلين على النحو التالي:
الفصل الأول: مفهوم السبب.
المبحث الأول: سبب الالتزام, المبحث الثاني: سبب العقد, المبحث الثالث: السبب غير الصحيح.
