تناول هذا المؤلف ماهية السياسة الجنائية: فروعها، طبيعتها، خصائصها، وتحديد مفهومها الذي لا يقتصر على المبادئ اللازمة لمنع الجريمة وتوقيع العقوبة المقررة لها، وإنما يمتد إلى تحديد مبادئ التجريم، وإن السياسة الجنائية وإن كانت تهدف إلى توجيه المشرع نحو تطوير القانون الجنائي إلا ان استجلائها يرشد جمع السلطات القائمة على تطبيق هذا القانون وتنفيذه.
وتهدف السياسة الجنائية المعاصرة إلى تطوير القانون الجنائي ودعم آليات التعاون الدولي كضرورة حتمية يفرضها الواقع الحالي ويستلزمها تزايد الأنشطة الإجرامية عبر الوطنية، وتعاظم حجم ونوع الإجرام المعلوماتي وجسامة أخطاره وفداحة خسائره وصعوبة الوصول للعدالة الناحزة وارتفاع تكلفة الجريمة.
وفي ضوء السياسة الجنائية المعاصرة فإنه يجب تقييم قانون العقوبات المصري الحالي لمواجهة المشكلات المعاصرة والتغيرات الاجتماعية التي مرت بالمجتمع والبحث في أسس تطويره في ضوء الاتجاهات العلمية الحديثة والأساليب الفنية المتطورة، كما يجب بحث القوانين العقابية الخاصة التي تعكس التطور التشريعي المواكب للتغيرات الاجتماعية وتقييم مدى نجاحها في المواجهة الشاملة.
وبالنسبة للسياسة الجنائية الإجرائية فقد برز اتجاه مهم للتحول عن الخصومة الجنائية كوسيلة تقليدية للوصول إلى حق الدولة في العقاب واتخاذ إجراءات غير جنائية تجاه المتهمين بارتكاب بعض الجرائم التي لا تهدد أمن المجتمع بخطر جسيم، والأخذ بأنظمة للتسوية كنظام الوساطة والتسوية الجنائية، ونظام المثول على أساس الاعتراف المعروف في النظام الأمريكي.
وأظهر المؤلف أن التعاون الدولي شرطًا أساسيًا لنجاح السياسة الجنائية الحديثة لمكافحة الجريمة لا سيما في صورها العابرة للحدود، واتخذ هذا التعاون صورًا متنوعة كتسليم المجرمين والإنابة القضائية، ونقل المحكوم عليهم والاعتراف بالأحكام الجنائية الأجنبية وتنفيذها والإجراءات المتبعة في شأن ضبط ومصادرة عائدات الأنشطة غير المشروعة وكيفية التصرف فيها.
ولتحقيق الأمن والسلام والعدالة على المستوى الدولي فقد تم إنشاء المحكمة الجنائية الدولية عام 2002م، كنظام قضائي دائم مختص بالفصل في القضايا الجنائية الجسيمة موضع اهتمام المجتمع الدولي كالجرائم ضد الإنسانية وجرائم الحرب والعدوان والإبادة الجماعية، في حيدة واستقلال تامين.
