يعد موضوع الحبس الاحتياطي من أهم وأخطر الموضوعات الشائكة في إجراءات التحقيق الجنائي، وأكثرها مساسًا بحرية المتهم، لذلك فقد حرصت المواثيق الدولية والدساتير والقوانين الإجرائية على وضع الضمانات التي تكفل حماية الحق في الحرية والتنقل وتقييد الحبس الاحتياطي والتعويض عنه. وهو ما حدا بالمشرع المصري إلى إصدار القانون رقم 145 لسنة 2006 والقانونين رقمي 153،74 لسنة 2007 متضمنًا إعادة تنظيم ضوابط تحدد حالاته ومعايير ممارسته، وإيجاب تسبيب الأوامر الصادرة به، أو بتجديده، كالشأن بالنسبة للأحكام الجنائية وإتاحة سبيل الطعن من الأوامر الصادرة به أو بمده، وتقرير مبدأ التعويض عنه وتنظيم التعويض الأدبي وكفالة الدولة للحق في التعويض المادي بقانون خاص لم يصدر بعد.. وهو ما جعلنا نتناوله بالبحث والدراسة المقارنة حتى تكون عونًا للباحثين في هذا المجال.
