القانون الجنائي الدولي هو مجموعة من القواعد القانونية تبين الفعال التي تعد جرائم دولية وتحدد العقوبات المقررة لها، وتبين الإجراءات التي يتعين اتباعها عند ارتكاب إحدى هذه الجرائم حتى يمكن توقيع العقاب على من تثبت مسئوليته عنها. وهذا التعريف يحدد على نحو واضح موضوع القانون الجنائي الدولي: فهو يبحث في الجريمة الدولية ليحدد الأركان التي تقوم عليها والعناصر التي يعتمد عليها كل ركن منها والعقوبات المختلفة التي توقع من أجلها، ثم هو يتناول بالتفصيل الجرائم الدولية المتعددة لكي يحدد لكل جريمة منها أركانها الخاصة بها والعقاب المقرر لها، ويتناول في النهاية البحث في الإجراءات التي تنشأ عن الجريمة الدولية وتستهدف توقيع العقاب من أجلها، وتتكون من مجموعها "الدعوى الجنائية الدولية"، فالمجتمع الدولي- شأنه في ذلك شأن المجتمع الوطني- في حاجة إلى مجموعة من قواعد السلوك تحكم نشاط أعضائه، وفي هذا النطاق يأتي هذا الكتاب على قسمين يتناول الأول منهما تاريخ القانون الجنائي الدولي، ثم القسم الثاني متناولاً النظرية العامة للجريمة الدولية، وذلك في أربعة أبواب هي: (الباب الأول: الركن الشرعي للجريمة الدولية، الباب الثاني: الركن المادي للجريمة الدولية، الباب الثالث: الركن المعنوي للجريمة الدولية، الباب الرابع: الركن الدولي للجريمة الدولية).
