من الحقائق الثابتة التي لا تحتاج إلى مزيد من التأكيد أن موضوع الجزاءات الدولية أضحى في الزمن المعاصر مركز اهتمام عالمي شديد، غير أنه ليس موضوعاً حديثاً، بل تمت إثارته مرات عديدة، من خلال المناداة بمعاقبة مجرمي الحرب العالمية الأولى والثانية، وتشكيل محاكم دولية كان أهمها محكمتي نورمبرج وطوكيو، كما تمّ القيام برفض بعض الجزاءات على عدد من الدول أثناء عهد عصبة الأمم.
حول هذا الموضوع الجزاءات الدولية تأتي دراسة الباحث في هذا الكتاب، حيث قسّمها إلى بابين رئيسيين مسبوقين بفصل تمهيدي تناول فيه التعريف بالجزاءات الدولية من خلال استعراض الاتجاهات الفقهية بشأن خاصية عنصر الجزاء في القاعدة القانونية الدولية، ثم التعرف على ماهية الجزاءات الدولية وأنواعها. مخصصاً الباب الأول لدراسة الجزاءات التي تطبق على الأشخاص الاعتبارية "الدول" من خلال التعرض إلى الجزاء الدولي من حيث الأسس والشرعية في فصل أول، ليتعرض بعد ذلك وفي الفصل الثاني إلى الجزاءات الدولية في إطار الاتفاقات والمواثيق على ضوء تناول الجزاءات الدولية في ميثاق الأمم المتحدة، بالإضافة إلى دراسة الجزاءات المفروضة على الجماهيرية كنموذج للجزاءات المطبقة على الدول.
وأما الباب الثاني في هذه الدراسة، فقد تناول فيه الباحث الجزاءات المطبقة على الأفراد في إطار القضاء الدولي الجنائي المؤقت، المتمثل في محاكمات الحرب العالمية الأولى والثانية سابقاً، والمحكمة الجنائية الدولية لمحاكمة مجرمي الحرب في يوغسلافيا والمحكمة الجنائية الدولية لرواندا حالياً جاء ذلك في الفصل الأول. أما الفصل الثاني فقد دار حور الجزاءات المطبقة على الأفراد في إطار القضاء الدولي الجنائي الدائم، حيث يتعرض المؤلف في هذا الفصل إلى الإطار التاريخي لتطور فكرة إنشاء محكمة جنائية دولية، وقد تناول في هذا الفصل الملامح الرئيسية للنظام الأساسي للمحكمة الجنائية الدولية، وأخيراً نظام الجزاءات في النظام الأساسي وكيفية تنفيذها.
