وإجراءات الإستدلال التى تباشر بمعرفة مأمورى الضبط القضائى تثبت فى محضر يطلق عليه محضر جمع الإستدلالات يتضمن جميع الإجراءات التى يقوم بها مأمور الضبط القضائى مبينآ وقت إتخاذ الإجراءات ومكان حصوله، كما يجب ان تشمل تلك المحاضر زيادة على ما تقدم توقيع الشهود والخبراء الذين سمعوا وترسل المحاضر النيابة العامة مع الأوراق والأشياء المضبوطة للتصرف فيها، وقد يكوتن تصرف النيابة العامة على محضر جمع الاستدلالات فتأمر بحفظ الأوراق إذا رأت عدم السير فى الدعوى الجنائية أو تكلف المتهم بالحضور أمام المحكمة المختصة وتحيل المحضر إلى المحكمة للفصل فى الدعوى وذلك فى الجنح والمخالفات، أما إجراءات التحقيق فالمقصود بها "تلك الإجراءات التى تصدر من سلطة التحقيق بقصد إثبات وقوع الجريمة فى أركانها القانوينة ونسبتها إلى فاعلها"، وتعتبر الدعوى الجنائية قد حركت بمباشرة أول عمل من أعمال التحقيق يباشره أحد أعضاء سلطة التحقيق حقيقة أو حكمآ، وتتصرف سلطة التحقيق فيه بعد إتمامه بمعرفتها ويكون ذلك إما بإحالة الدعوى إلى المحكمة وإما بالأمر بعدم وجود وجه لإقامتها، وعلى ذلك فالإجراءات السابقة على المحاكمة الجنائية تشمل: إجراءات جمع الإستدلالات وإجراءات التحقيق الإبتدائى.
وفى ضوء ما تقدم ستنقسم دراستنا فى خطوات سير التهمة قبل وصولها إلى مرحلة المحاكة إلى بابين الأول: الاستدلال، والثانى: هو التحقيق الإبتدائى.
