إن تغيير النظام السياسي في بعض الدول الموحدة ومنها العراق يرتب عدة نتائج من أهمها تغيير في طبيعة نظام الحكم وشكل الدولة وتركيبتها الدستورية، حيث يبدأ التحول في نظام الحكم السياسي من نظام تركيز للسلطة إلى نظام توزيع وتقاسم للسلطة، كما جرى التحول في تكوين الدولة من الدولة الموحدة البسيطة إلى الدولة المركبة الإتحادية، وجرى تقنين القواعد الدستورية المنظمة لذلك في وثيقتين دستوريتين هما: دستور العراق لعام 2004 (قانون إدارة الدولة العراقية للمرحلة الإنتقالية)، ودستور جمهورية العراق لعام 2005.
إن قراءة متفحصة لدستور العراق الصادر عام 2005 ونظرة علمية موضوعية للأحكام المنظمة للشكل الإتحادي للدولة وللمؤسسات الدستورية والصلاحيات والإختصاصات الممنوحة لها، يتضح لنا أن الدستور يؤسس لنظام إزدواجية السلطة في الدولة الإتحادية.
وسنعرض لإزدواجية السلطة في الدولة الإتحادية من خلال بيان محتوى الدستور الإتحادي الصادر عام 2005، وبنية النظام الإتحادي، وتنظيم السلطة على المستوى الإتحادي، وتنظيم السلطة على مستوى الوحدات المكونة للإتحاد، وتوزيع الإختصاصات، والعلاقة بين السلطات الإتحادية بالسلطات المحلية، وتنظيم الشؤون المالية والإقتصادية للدولة الإتحادية.
