حيث توجد السلطة توجد المسؤولية، فمن يمارس السلطة، لا بد أن يخضع للمسؤولية، وهذا التلازم بين السلطة والمسؤولية، يعتبر عاملاً حاسماً، لتأسيس نظام الحكم في الدولة المعاصرة، والذي بدوره، يعتبر أساساً لتطوير المجتمع في كافة المجالات القانونية والسياسية والإقتصادية والإجتماعية.
ومن هذا المنطلق، أجازت الدساتير، زوال الحصانة الرئاسية، في حالة إتيان رئيس الدولة لأفعال تنطوي تحت "الخيانة العظمى".
ولأن هذا الموضوع يثير إشكاليات عدة تتصل بالواقع السياسي وطبيعة الخيانة العظمى ومضمونها، يقتصر مؤلف هذا الكتاب الدكتور "رافع خضر صالح شُبَّر / أستاذ القانون العام في جامعة بابل على دراسة مضمون الخيانة العظمى المنسوبة لرئيس الدولة، في الأنظمة الجمهورية المعاصرة - وخاصة - العراق، ومصر واليمن والولايات المتحدة الأميركية، وفرنسا، في محاولة لتبيان التنظيم الدستوري، وتحليل الأحكام الدستورية المتعلقة بالخيانة العظمى.
أما عن أهم النتائج التي توصلت إليها الدراسة فهي ما يشير إليه الواقع العملي، "أن القواعد الدستورية المتعلقة بمساءلة رئيس الدولة عن الخيانة العظمى، لم تجد مجالاً في التطبيق، وذلك لسببين: الأول؛ يتمثل في إمتناع البرلمان عن إثارة المسؤولية الرئاسية، والثاني؛ يتمثل في ضعف أداء البرلمان وإمتناعه عن إصدار قانون خاص بمحاكمة رئيس الجمهورية يعمل على تكملة النصوص الدستورية، وتطبيقها فعلياً".
