تأخذ الدولة من حيث تنظيمها الإداري، بأحد أسلوبي الإداري: المركزية أو اللامركزية، وتُعّد الفدرالية أحد أشكال الدول التي تتيح الفرصة لمكوناتها الإجتماعية المتنوعة أن تحكم نفسها بنفسها بدرجة محددة من الإستقلالية مع الإبقاء على رابط الوحدة في ضوء الإتحاد الفدرالي.
فإذا كانت تركيبة التنظيم الإداري في الدولة البسيطة أمراً ميسوراً لبساطة بنيانها السياسي، فما هو تأثير الشكل الإتحادي للدولة في تنظيمها الإداري؟ إذ تتسم بثنائية سلطة الحكم وتسمح بإزدواج السلطات الإدارية، وما هو المركز القانوني للإدارة المحلية في هذه الدول، فهل تباشر هيئات هذه الإدارات صلاحياتها على المستوى الفدرالي أو الإقليمي او على المستويين معاً؟...
كما أن بعض الأنظمة الفدرالية تتضمن وحدات إقليمية خاصة، لها وضع دستوري أقل من الوحدات الرئيسية المكونة للإتحاد (الوحدات الفدرالية) مما يجعلها عادة خاضعة قانونياً للحكومة الإتحادية، مثلما عليه الوضع في العراق، حيث أنّ هناك إقليمياً واحداً فقط، وهو إقليم كوردستان، ومحافظات غير منتظمة في الإقليم، وقوانين متعلقة بالتنظيم الإداري تسري على المحافظات دون الأقاليم.
