اول دستور طبق على عراق الولايات هو الدستور العثماني 1876 ولم يرد فيه ذكر للقضاء الدستوري وبالرغم من ان القانون الاساسي العراقي لعام 1925 اول دستور للعراق (الدولة الحديثة) وقد اوكل الدستور الى المحكمة العليا التي تتشكل من تسعة اعضاء اربعة من اعضاء مجلس الاعيان واربعة من اعضاء محكمة التمييز والتي تنعقد برئاسة رئيس مجلس الاعيان وعند تعذر حضوره يكون رئيس المحكمة (نائبه) - م82 من دستور 1925 وهي التي تختص بتفسير القانون الاساسي والنظر كذلك بعدم قانونية دستورية القوانين للقانون الاساسي واختصاصات اخرى.
