يعد الإتفاق بمثابة تعاقد بين دولتين أو أكثر، يتناول قضايا سياسية أو إقتصادية أو تجارية أو مالية أو عسكرية أو أمنية تهم الدول المتعاقدة إلى الدرجة التي لا ترقى إلى أن تعقد معاهدة بشأن تلك الجوانب أو الإهتمامات.
وصارت الإتفاقات الدولية العلنية سمة أساسية من سمات التعامل الدولي، وذلك لتجنب المساس بالمصالح العليا للدولة، الذي يمكن أن يحصل في إطار الإتفاقات الدولية السرية من جهة، وإتاحة المجال للشعوب المعنية في بيان رايها في أحكام ومضامين الإتفاقات الدولية التي تعقدها حكوماتها.
ولقد تولدت فكرة هذا الكتاب بعد إبرام الإتفاقين بين العراق والولايات المتحدة الأمريكية، وما أثير حولهما من جدل، وبعد النص في قانون التصديق على عرضه على الشعب لأخذ رأيه فيها عن طرييق الإستفتاء العام.
ولقد تم تقسيم خطة هذا الكتاب إلى مقدمة ومدخل عام وأربعة فصول، تناول الفصل الأول منها الوضع القانون الدولي للعراق قبل إبرام الإتفاقية، وتناول الفصل الثاني إتفاقية إنسحاب القوات الأجنبية بوصفها محلاً للإستفتاء، أما الفصل الثالث فقد بحث في الآلية الدستورية لإبرام الإتفاقية وموقع الإستفتاء العام منها، بينما بحث الفصل الرابع في القواعد الدستورية والقانونية للإستفتاء العام حول الإتفاقية.
