Book Description
يؤسس الدستور القواعد المنظمة للسلطات الحاكمة في الدولة، ويبين تكوينها ويجدد إختصاصاتها التي تمارسها بصدد التعبير عن إرادة الدولة في صورة قرارات أو قواعد قانونية؛ ولما كانت القواعد الدستورية تنشأ عن السلطة المؤسِسَة (السلطة التأسيسية الأصلية) في الدولة، وهي السلطة العليا فيها، فإنه من المنطقي ان تكون لهذه القواعد المرتبة الإلزامية العليا.
وعليه، فإن ممارسة السلطة من قبل رئيس الدولة، تخضع للقواعد الدستورية التي تحدد الأحكام الموضوعية والشكلية التي يتوجب مراعاتها، عند ممارسته لإختصاصاته.
وعليه، فقد اتجهت إرادة واضعي الدساتير إلى إجازة تحريك الإجراءات القانونية لإتهام ومحاكمة رئيس الدولة في حالة خرقه أو إنتهاكه للقواعد الواردة فيها، والمحددة لنطاق ممارسته للسلطة.
ورغم إن أغلب الدساتير قد نصت على مسائلة رئيس الدولة في حالة إنتهاك الدستور، إلاّ أن تطبيق نظام المسائلة يواجه إشكاليات عدة؛ لذلك تتبع هذا البحث موضوع مضمون إنتهاك الدستور المنسوب لرئيس الدولة منهج الدراسة التأصيلية التحليلية المقارنة بين نماذج دستورية رئيسية تتمثل في العراق ومصر ولبنان واليمن وفرنسا والولايات المتحدة الأمريكية وإيطاليا والهند وجنوب أفريقيا وروسيا الإتحادية، مع الإشارة لبعض النماذج الدستورية الأخرى بحسب مقتضيات محاور البحث.
وفي ضوء هذه المنهجية قسم البحث على النحو الآتي: الفصل الأول: "ذاتية حالة إنتهاك الدستور"، الفصل الثاني: "المحتوى الموضوعي لحالة إنتهاك الدستور"، الفصل الثالث: "الأفعال المكونة لحالة إنتهاك الدستور"، الخاتمة: "وتتضمن أبرز النتائج والتوصيات".
