وفروع القانون الخاص؛ كالقانون المدني؛ والقانون التجاري، والقانون البحري، وقانون العمل. وفرعا القانون المختلط: كقانون أصول المحاكمات المدنية، والقانون الدولي الخاص.
ويهدف هذا الكتاب من خلال الدراسة المقارنة للقانون الوضعي وفقه الشريعة إلى معرفة طبيعة كل منهما، وأقسامهما، وفروعهما، ومدى أوجه التشابه أو التمايز بينهما من خلال الدراسة العلمية الموضوعية دون تحيّز أو محاباة، وسوف يرى القارئ أن فقه الشريعة في قسمه الخاص بالمعاملات قد تناول جميع فروع القانون اللازمة لتنظيم العلاقات كافة بين الأفراد بعضهم ببعض مسلمين وغير مسلمين، وبينهم وبين الدولة، وبين الدولة والدول الأخرى.
وأن هذا التنظيم ولئن لم يكن بذات المصطلحات المعروفة عند القانونيين المعاصرين، غير أنه تناول جميع فروع القانون الوضعي من حيث ذات الموضوعات، كون فقه الشريعة دين ودنيا، والدنيا تحتاج إلى معاملات منظمة شرعاً على كافة الأصعدة.
