يُعبّر قانون العقوبات عن مجموعة من النصوص القانونية التي تُحدِّد الأفعال المعتبرة جرائم، والأشخاص المسؤولين عنها، والجزاءات التي يستحقّونها عملاً بالمبدأ المكرَّس عالمياً بأنه لا جريمة ولا جزاء إلاّ بوجود النص القانوني بذلك.
وتدور محاور هذا القانون حول الموضوعات التالية: المقدمة - معالم هذا القانون؛ القسم الأول - خصوصيته ونطاق تطبيقه في الزمان والمكان على الأشخاص؛ القسم الثاني - نظرية الجريمة؛ القسم الثالث - نظرية المسؤولية الجزائية، والقسم الرابع - نظرية الجزاء.
إذا كان من ميزة مضافة في هذا الكتاب أنه حاول إضافة عناوين الرسائل والأطاريح والإجتهادات في هوامش الصفحات لفائدة البحث الجامعي، آخذاً بالإعتبار النصوص القانونية الجديدة، ومظهراً معالم النظام الجديد لتخفيض عقوبات الأحكام النافذة حيث شُرع بتنفيذه مؤخراً، هذا النظام الذي تجاهلته معظم المؤلفات لكونه كان ملغى في قانوننا، ثم أُعيد العمل به ولئن بتسمية غير دقيقة وهي قانون تنفيذ العقوبات.
ومن المؤمّل أن يرضي هذا الكتاب من يرى فيه الفائدة والإحاطة الممكنة في موضوعاته، دون الإدعاء بالإقتراب من الكمال، إذ هذه الصفة الأخيرة ليست متاحة للبشر، وإنما هي من أسماء وصفات خالق البشر سبحانه وتعالى، فالبشر مهما أوتوا من العِلم يبقوا طلاب عِلم، ومن يدّعي أنه أصبح عالِماً لا يمارى في عِلمه وإجتهاده، وضع نفسه في موقع بعيد عن أدب العلماء حيث التواضع، وحيث السعادة والنجاح يتحققان له عندما يعثر على الحقيقة التي يرغب في إعلانها.
