إن الله تعالى فطر الناس على حب الخير والتعاون، وحثَّ في كتابه على التعاون والتناصر على الحق والخير والعدل، ولم يكتف الإسلام بمجرد الدعوة إلى التعاون والتكافل، بل شرع لأجل تحقيقه مجموعة من الأحكام، فجعل الصدقات المفروضة، ركناً من أركان الإسلام، وفرض النفقات، والكفارات، والحقوق والإلتزامات التي تحمل المجتمع على رقائق التكافل والتعاون.
وإذا نظرنا إلى التأمين كفكرة لتحقيق التعاون، ودفع شرور العوز والحاجة والعجز، ولتفتيت المخاطر بين الجماعة، فإن هذه الفكرة مقبولة شرعاً، بل مطلوبة، ولا ينبغي أن تترك الساحة إلى الفكر الإسترباحي في التأمين التقليدي، دون النظر إلى الحلال والحرام، وكان لازماً على المفكرين والفقهاء وأصحاب المال الحريصين على الحلال أن يقارعوا هذا الفن الملوث بالخبائث والآفات بفن يتفق وما أحل الله تعالى.
وقد بحثوا الموضوع: أولاً: من ناحية إستيعاب عقود التأمين، ثم تبيان ما لا يتفق منها مع المبادئ الإسلامية والخوض فيها بعمق مع ملاحظة كل الظروف والملابسات التي تحيط بها، لأن الحكم على شيء فرع من تصوره؛ ثانياً: إن مبدأ التعاون ما دام مشروعاً، ومطلوباً في شريعتنا الغراء، علينا أن نضعه في إطار عقود ونُظُم تحقق هذا الغرض المنشود على أكمل وجه، كون الشريعة لم تترك مصلحة إلا وأقرتها ولا مفسدة إلا وحظرتها، كما أنها لم تترك شيئاً محرماً دون بديل نافع صالح، فكانت نصوصها في كثير من المواضيع عامة، رحمة بالأمة وأجيالها.
ولأهمية هذا الموضوع تناوله المؤلف في صفحات هذا الكتاب ليبين الفرق بين التأمين في النظام الوضعي والتأمين في النظام الشرعي.
