يقصد من هذه الدراسة إعطاء معلومات إجمالية وأفكار أولية عن علم القانون في النظامين الوضعي والإسلامي، من خلال الدراسة المقارنة التي تُتيح معرفة أوجه التشابه أو الاختلاف أو التمايز بينهما. فهذه الدراسة تتجه إذن إلى أهم موضوعات القانون الوضعي والشريعة الإسلامية، وهو موضوع نظرية القانون في الأول وفقه المعاملات الشرعية في الثانية.
وبذلك يوضع هذان النظامان الوضعي والإسلامي جنباً إلى جنب فيما هو ضروري ومفيد، لمعرفة معالم كل منهما ومدى التقائهما حول المبادئ والأفكار، رغبةً في تشجيع الدراسات المقارنة بين الأنظمة القانونية المتعددة المعمول بها داخل الدولة الواحدة من قبل الطوائف الدينية التي تتألف منها، أو داخل التجمعات الإقليمية والعالمية من قبل الدول التي تتشكل منها.
هذا وتشتمل هذه الدراسة على الفصول التالية: الفصل الأول: التعريف بالقانون والشريعة والفقه والإسلامي. الفصل الثاني: خصائص القواعد القانونية والشرعية. الفصل الثالث: أقسام القانونيين الوضعي الإسلامي وفروعهما.
تتيح دراسة المدخل إلى علم القانون الوضعي فرصة فتح نافذة على عالم القانون بمجمله، والإطلالة العامة على مبادئه من حيث تعريف القانون ومعرفة خصائصه، وبيان أقسامه وفروعه، والتطرق إلى مصادره وأوجه تطبيقه ووسائل تفسيره.
وتهيئ دراسة المدخل إلى فقه الشريعة الوسيلة الفضلى للاطلاع العام على حقيقة الشريعة الإسلامية وأقسامها، والإلمام بمصطلحاتها، ومعرفة القواعد والنظم التي جاءت بها، وبيان مصادرها، ونطاق تطبيقها، وكيفية تفسير نصوصها.
وتهدف الدراسة المقارنة للقانون والشريعة إلى إعطاء معلومات عامة وأفكار أولية عن معالمهما بإظهار أوجه التشابه أو الاختلاف أو التمايز بينهما، وذلك عن طريق الدراسة الموازنة التي تقوم على المقابلة بين موضوعاتهما وأفكارهما وفقاً للأسلوب المتبع في مؤلفات القانون الوضعي، لأنه أيسر على الفهم وأكثر شيوعاً.
