نظراً للتقدم في جميع مجالات الطب، يجب وضع الضوابط وسن القوانين التي تحكم ممارسة الطبيب للعمل الطبي، والطبيب المسلم أولى من غيره بالإلتزام بهذه الضوابط، فعليه واجب شرعي بأن يتسلح بفقه يساعده على إنجاز عمله، وخوف من الله ينير له الطريق، كما يجب عليه أن يتعرف على الأخطاء الطبية ومسئوليته تجاهها، وأن يتعرف على الفرق بينها وبين المضاعفات التي قد تحدث رغم أخذه بك ما سبق من تقنية وتدريب ومهارات والذي يطلق عليه الغلط العلمي، فالقانون يحاسبه على الخطأ الطبي ولكن لا يحاسبه على الغلط العلمي، وتحقيقاً للتعاون بين الفقه القانوني والشرعي، فيجب نشر الثقافة الطبية والقاننية والشرعية وثيقة الصلة بالأعمال الطبية، حتى يمكن وضع هذه التطورات العلمية في نصابها القانوني والشرعي ضبطاً لأصل مشروعيتها وتحديداً للمسئولية الناشئة عنها، مما يوجب على المتخصصون في الطب والقانون والشريعة التعاون لوضع هذه الضوابط اللازمة لممارسة الأعمال الطبية، وتحليل القضايا الناتجة عن هذه الممارسات الطبية، واقتراح الحلول الجذرية لها حفاظاً على صحة الفرد وأمن المجتمع، وفي محاولة جادة للمساهمة في نشر هذه الثقافة قمت بإعداد هذا البحث الضوابط الشرعية والقانونية للعمل الطبي.
