يثير موضوع العقم وبالتالي الإنجاب الصناعي العديد من المشاكل منها ما هو فسيولوجي ومنها ما هو أخلاقي ومنها ما هو قانوني، لذلك كان لا بد من التعرض ابتداءًا لتعريف العقم وبيان أسبابه ومشروعية التخلص منه، وفي العلاج من هذه المشكلة وصل العلم الحديث إلى ما يسمى "الإنجاب الصناعي" حيث أثيرت من جديد المشكلة العامة في شأن المشروعية في ضوء التقنيات الحديثة بين معارض ومؤيد، وقد أثيرت أيضًا في مجال التلقيح الصناعي مسألة الإنجاب الصناعي بعد وفاة الزوج وهو ما يطرح فورًا مسألة أخلاقية وشرعية وقانونية انطلاقًا من أن وفاة الزوج تنهي العلاقة الزوجية، ومع ذلك فقد وجد من يجيز ذلك فقهًا وقضاءًا في فرنسا.
وعلى نسق هذه التساؤلات يطرح الإنجاب الصناعي الكثير من المشكلات الأخرى (إذا نحينا جانبًا مسألة التلقيح بعد وفاة الزوج)، ومن ذلك الإخصاب الصناعي الخارجي (طفل الأنابيب) سواء فيما بين الزوجين وهو ما لم يثر مشكلة حادة، والإنجاب بتدخل الغير وهو ما يثير مشكلة حقيقية أخلاقية وشرعية، وبالتالي قانونية في شأن ما يسمى إيجار الأرحام ومدى مشروعيته في الفقه الإسلامي وفي القانون الوضعي ولدى الفقه، وفضلًا عن تعريف هذا العقد وتمييزه عما يختلط به أو يشبهه، وفي النهاية سوف نعرض لما يثيره ما يسمى بنوك الأجنة التي تحفظ النطف البشرية للتعامل فيها، ثم مشكلة التكييف القانوني والشرعي للبويضات الملقحة، هذا كله ما سنتناوله بالدراسة في هذا البحث وفقًا للأبواب الأربع الآتية: [الباب الأول: العقم والجنين ومبدأ حرمة الجسد الإنساني، الباب الثاني: التلقيح الصناعي الداخلي، الباب الثالث: الإخصاب الصناعي الخارجي، الباب الرابع: استئجار الأرحام (الرحم الظئر)].
