على الرغم من الخلاف القائم علماء الاقتصاد وعلماء القانون حول سياسة المنافسة، حيث يذهب بعض علماء الاقتصاد إلى أن مسائل المنافسة من المسائل التي لا يهتم بها علماء القانون، ولا يعبأون بها؛ لأنهم ينظرون إليها على أنها قضية من قضايا الاقتصاد، في حين يذهب علماء القانون إلى أن علم الاقتصاد مازال لا يملك السيطرة على مفهوم المنافسة، بالإضافة إلى أن علم الاقتصاد يمكن أن يستغنى عن التعريفات التي يضعها علماء القانون والقضاة.
فإن ذلك كله رغم هذا الخلاف في الرأى لا ينفي أن موضوع مكافحة الاحتكار من الموضوعات الشائكة والشديدة الحساسية والأهمية أيضًا، كما أنه يتسع ويحتاج للدراسات القانونية والاقتصادية على السواء؛ لذا كان من الضروري التعرض لهذا الموضوع بالدراسة القانونية، وذلك على ضوء النظريات الاقتصادية والآليات التي تؤدي إلى الاحتكار حتى يمكن تلمس السبل الممكنة للحد منه. وذلك من خلال ثلاثة أبواب هي: الباب الأول: الأسس العامة لمواجهة الاحتكار، الباب الثاني: الممارسات الاستبعادية، الباب الثالث: اتفاقات المنتجين.
