بدأت تجارة الخدم أو الخادمات القادمات من سيريلانكا والفلبين وأثيوبيا وبنغلادش..., عبر مكاتب خاصة أو شركات قائمة الآن في بعض البلدان حيث يذهب مندوبو هذه المكاتب أو الشركات إلى هناك ويتعاقدون مع هؤلاء الشبان أو الشابات في مواطنهم الأصلية وذلك بتوقيع عقود الاستخدام الخاصة.
ولا يمكن لهؤلاء المستخدمين أو المستخدمات أن يتصوروا مقدار أو نسبة نفاذ هذه العقود, فالعقد شيء والواقع شيء آخر, إذ ينحصر عمل هذه المكاتب أو الشركات بصورة خاصة في كل ما يتعلق بالأوراق اللازمة وببطاقة الطائرة وكلفتها والحصول على الفيزا المطلوبة, وكذلك بإبرام عقد ثاني هذه المرة مع رب العمل الذي يستخدم الخادم.
وقد تنبه القليل من التشريعات المقارنة إلى ذلك فوضعت تشريعات خاصة لتنظيم عقد الخدمة في المنازل وعمل الخدم وبيان حقوق وواجبات الأطراف المتعاقدة. وعليه فإن دراستنا تتركز في بحث العلاقة القانونية الناشئة بين أطراف العلاقة التعاقدية في (عقد الخدمة في المنازل).
مشكلة البحث تكمن في أن أغلب التشريعات المقارنة ومنها التشريع العراقي قد استثنت عمل خدم المنازل من أحكام قانون العمل, وبالمقابل لم تنظم عملهم وفق تشريع خاص بهم مما أدى إلى ترك فراغ تشريعي في هذا المجال. وسوف نتبع في دراسة هذا الموضوع المنهج المقارن, فقد تناولنا موضوع الدراسة من خلال مبحث تمهيدي وفصلين على الوجه التالي: المبحث التمهيدي فيه عقد الخدمة في المنازل.. انتشاره في المجتمع الكردستاني وخصائصه وتعريفه, الفصل الأول فيه الطبيعة والتكييف القانوني لعقد الخدمة في المنازل, الفصل الثاني فيه أحكام عقد الخدمة في المنازل, الخاتمة وتتضمن أهم النتائج والتوصيات.
