مع مغالاة بعض المحامين فى أتعابهم, واستغلال ظروف الرجل البسيط الذى يتعرض للقهر فى البداية ممن ظلمه وأجبره على التوجه للمحكمة, وثانيا عندما اضطرته ظروفه التوجه لذلك المحامى طالبا مساعدته ورفع الظلم عنه فما كان منه إلا استغلالا لتلك الظروف.
وإيمانا بحق المحامى فى حياة كريمة يوفر فيها لآسرته ضرورات الحياة الشريفة, وتذليل مصاعبها, ليتفرغ لأداء مهنته فى سهولة ويسر وحتى نرفع عنه الحرج أو أن يقع فى براثن عملاء يرفضون منحه أتعابه, ومن ثم فقده لمصدر رزقه وفى ضوء التشريع المصري والتشريع المقارن وأحكام القضاء نبحث حول حماية قانونية لحق المحامى فى أتعابه, خاصة بعد صدور أحكام المحكمة الدستورية التى ألغت بعض الأسس فى تقدير الأتعاب, سوف نتناول من خلال هذا البحث الحماية القانونية لحق المحامى فى الأتعاب وذلك من خلال الفصول التالية مايلى: الفصل الأول: ماهية المحامى, الفصل الثانى: العلاقة العقدية بين المحامى والعميل, الفصل الثالث: أسس تقدير أتعاب المحامى, الفصل الرابع: ضمانات حصول المحامى على أتعابه.
