أريد في هذا البحث بيان التزامات وحقوق الحاضنة والمحضون له حتى لا يحدث هذا الصراع الذي يؤثر سلبيًا على مصلحة الولد ومستقبله.
وخاصة انحرافه فأغلب أسباب انحراف الأحداث ترجع إلى أسباب اجتماعية وبيئية وأهمها الطلاق. وتفكك الأسرة بسبب غياب أو مرض أحد الأبوين.
وإذا كنا قد فقدنا عددًا من الشباب المتطرف والعدواني الذي أغلق بالفعل عقله وقلبه عن الحوار، والاستماع إلى النصح، والعودة إلى الحق فينبغي أن نوجه اهتمامنا إلى الأعداد الأخرى التي من الممكن ان تتبع نفس الخط، حتى نسرع بحمايتهم من الوقوع فيه، أو الانسياق في تياره.
وقد كان منهجي يقوم على عرض المسألة التي أتناولها بالبحث والدراسة مع ذكر ما اتفق عليه الفقهاء في هذه المسألة إن كان هناك اتفاق مؤيدًا بالدليل ما استطعت إلى ذلك سبيلًا، تحرير محل الخلاف بين الفقهاء في المسألة، جمع أصحاب كل رأي في مذهب واحد، مع ذكر أصحاب هذه الآراء مع عدم الاقتصار على عرض رأي مذهب واحد لأن الاقتصار على مذهب واحد في موضوع معين لا يقدم صورة صادقة عن عظمة الفقه الإسلامي، وعمق تناوله ودقة معالجته وتنوع آرائه وتشعب اجتهاداته، استقاء آراء كل مذهب من كتبه الأصلية المعتمدة تطبيقًا لقواعد البحث العلمي السليم، ذكر أدلة كل مذهب ومناقشتها إن دعا الأمر إلى ذلك وصولًا إلى الرأس الراجح الذي يؤيده الدليل القوي وتعضده الحجة الواضحة دون التحيز لمذهب خاص خاصة وأن أكثر من تعرض لهذا الموضوع بالبحث والدراسة قد اعتمد في ذلك على الفقه الحنفي وحده، عرض الحكم القانوني في المسألة محل البحث من قوانين الأحوال الشخصية المعدلة بالقانون رقم 100 لسنة 1985م ولائحته التنفيذية مع عقد مقارنة بين الحكم الفقهي الراجح، وكذلك الرجوع إلى أمهات كتب التفسير والحديث وأصول الفقه وتخريج كل الأحاديث.
وعلى هذا فإنني أتحدث عن شروط ثبوت حق الحضانة في أربعة فصول كما يلي: (الفصل الأول: التعريف بالحضانة وبيان منزلتها في الفقه الإسلامي وقانون الأحوال الشخصية، الفصل الثاني: الشروط العامة لاستحقاق الحضانة المتفق عليها، الفصل الثالث: الشروط العامة لاستحقاق الحضانة المختلف فيها، الفصل الرابع: الشروط الخاصة لاستحقاق النساء والرجال حضانة الأولاد).
