القاضى هو نائب عن رئيس الدولة في السلطة القضائية وسلطته هى إحدى السلطات التى يتمتع بها الرئيس الأعلى للدولة لحفظ الدين وسياسة الدنيا وتنفيذ شرع الله.. واستقلال السلطة القضائية يساعد على إظهار هيبة القضاء وقوة شخصية القاضى وحرية ممارسته ويتمتع القاضي كذلك بالحصانة وهى عدم خضوعة للعزل من قبل الجهة التى تملك تعيينه فهو يحب أن يكون في مامن من العزل وحصانة من المؤثرات وألا يكون زمام راحة القاضي بيد شخص غير مجتمع إخوانه فيجب أن يكون القاضي مستقلا وهذا هو الأصل ويبين هذا الكتاب غزارة الفقه الإسلامي بشأن مبدأ الحصانة ضد العزل ودحض كل قول مفاده ان مبدأ عدم قابلية القاضي للعزل مبدأ حديث النشأة فالإسلام يقوم على مبدأ الشورى في الحكم وهو وحده كفيل بان يحصن القاضى فقبل عزل أى قاضي يجب استشارة عدد ممن هم اهل لذلك وذلك لخطورة العزل إذ قد يترتب عليه آثار تمس ضوابط المصلحة.
