يعتبر الأطفال في كل المجتمعات الأساس الذي تبنى عليه هذه المجتمعات فبإعداد الطفل الأعداد السليم يبنى المجتمع البناء الصحيح، لذا نجد إن كل القوانين الوضعية تحرص على إحاطة هذه الشريحة من شرائح المجتمع بالعناية والرعاية وتحاول تشريع القوانين التي تضمن لها كافة الحقوق.
وقد عنيت الشريعة الإسلامية قبل القوانين الوضعية بهذه المسألة فجاءت نصوص هذه الشريعة بأحكام مهمة ودقيقة أصبحت هذه الأحكام فيما بعد الأساس الذي تستند إليه القوانين الوضعية في إقرارها لحقوق الطفل.
ولأهمية هذا الموضوع فقد اخترناه موضوعاً لدراستنا إذ لا يخفى على أحد ما يعانيه واقع الأطفال في أغلب المجتمعات من الإهمال وعدم الرعاية بالإضافة إلى مختلف أنواع الظلم والأذى والإمتهان، وهو الأمر الذي يتطلب بحسب رأينا معالجات سريعة من كافة الدول لإنصاف هذه الشريحة الضعيفة والمستضعفة من شرائح المجتمع.
وسنحاول من خلال هذه الدراسة إبراز دور الشريعة الإسلامية السباق في مجال الرعاية والعناية بالطفل ومن ثم الوقوف على مواطن الخلل والضعف في معالجة القوانين الوضعية في إقرارها لحقوق الطفل.
ولما كانت حقوق الشخص في هذه المرحلة العمرية كثيرة ومتشعبة لذا ارتأينا قصر البحث في هذه الدراسة على تلك الحقوق التي تناولته قوانين الأحوال الشخصية وأتبعنا أسلوب المقارنة بين القوانين المختلفة من جانب ومقارنتها بالشريعة الإسلامية من جانب آخر، لذلك كان ميدان بحثنا في هذه الدراسة خمسة حقوق لصيقة بشخص الطفل لا تستقيم حياة الطفل إلا بإقرارها وهي حق النسب وحق الرضاع وحق الحضانة وحق النفقة بالإضافة إلى حق الولاية.
