إن أحكام الأحوال الشخصية تشمل الزواج والطلاق والنسب والحضانة والرضاع والوصية والميراث ونفقات الأقارب وأحكام الأهلية والحجر، وهذه الأحكام جاءت معظمها في القرآن مفصلة، ولعل سبب ذلك يعود إلى حرص المشرع على الإهتمام بهذه الأحكام وعنايته بها، وهذا ما دفعني إلى اختيار موضوع هذا الكتاب لعمل دراسة مقارنة بين الشريعة الإسلامية والنظم الغربية الحديثة.
وتكون خطة البحث مقسماً على إثنى عشر مبحثاً وخاتمة هي كالتالي:-
المبحث الأول: العلاقة بين الشريعة والقوانين الوضعية، المبحث الثاني: الأسرة قبل التكوين في المنهج الإسلامي، المبحث الثالث: الأسرة في النظم الغربية الحديثة، المبحث الرابع: موانع الزواج، المبحث الخامس: العلاقات الغير المشروعة وقياسها على التحريم بالقرابة المشروعة، المبحث السادس: المحرمات بالرضاعة، المبحث السابع: تعدد الزوجات، المبحث الثامن: الطلاق، المبحث التاسع: الخلع والرجعة، المبحث العاشر: الحضانة ورعاية الأولاد، المبحث الحادي عشر: الميراث في التشريع الإسلامي، المبحث الثاني عشر: المقارنة بين نظام الميراث في الإسلام والنظم الغربية الحديثة.
