وقد عالجنا في هذا الكتاب التكورات التي مر بها اجتهاد القضاء الإداري إلى أن وصل إلى رقابة التناسب . بالتحديد في القرارات المتعلقة بالحريات العامة والتأديب الوظيفي وكذلك الإستملاك للمنفعة العامة مبتكراً نظريتي الخطأ الساطع في التقدير والموازنة معتمدين على تطبيقات القضاء الإدار الفرنسي باعتبار أن القضائين اللبناني والمصري يتأثران بالتطور الفرنسي دائماً .
وانطلاقاً من رصدنا لمختف الأحكام ، اتضح لنا أن القضاء الإداري اللبناني والمصري وإن لم يستطيعا اللحاق بدرجة التطور التي وصل إليها القضاء الفرنسي نظراً لاختلاف المفاهيم السائدة في كل مجتمع إلا أنهما يسعيان إلى إرساء قاعدة مطلقة التطبيق مفادها إلزامية تطبيق مبدأ التناسب وبالتالي إضافته إلى لائحة المبادئ القانونية العامة .
