نتناول في هذه الدراسة مشروع التنظيم الأروبي (روما 2) بشأن القانون واجب التطبيق على الالتزامات غير التعاقدية مقارناً بما هو سائد في علم تنازع القوانين والاتفاقيات الدولية ذات الصلة بموضوع هذا التنظيم، فتبدأ الدراسة في كل مسألة ببيان الموقف منها وفقاً للقواعد العامة لعلم تنازع القوانين وأحكام الاتفاقيات الدولية، وتعقب ذلك بتفصيل أحكام تلك المسألة وفقاً للمشروع محل الدراسة.
وعلى ذلك ستأتي الدراسة في مبحث تمهيدي وأربعة فصول على النحو التالي: مبحث تمهيدي- الجهود الأوروبية لتوحيد قواعد القانون الدولي الخاص ونظرة إجمالية على مشروع التنظيم محل الدراسة، والفصل الأول: مجال تطبيق مشروع التنظيم محل الدراسة، والفصل الثاني: القانون واجب التطبيق على الالتزامات غير التعاقدية الناشئة عن الفعل الضار في علم تنازع القوانين ومشروع التنظيم محل الدراسة، والفصل الثالث: القانون واجب التطبيق على الالتزامات غير التعاقدية الناشئة عن العمل النافع في علم تنازع القوانين والمشروع محل الدراسة، أما الفصل الرابع: القواسم المشتركة بين الالتزامات غير التعاقدية الناشئة عن الفعل الضار وتلك الناشئة عن العمل النافع والأحكام العامة للمشروع محل الدراسة.
