وهذه المهنة قائمة في بلاد العالم المتحضر، وهي ضرورية ولازمة للذود عن حقوق الإنسان الشخصية والمادية، وشروط ممارسة هذه المهنة في معظم أنظمة العالم متشابهة من حيث الحصول على مؤهلات معينة في دراسة القانون، والتمتع بالأهلية المدنية الكاملة، بالإضافة للسيرة والسمعة المحمودة، ومن ضمنها أن لا يكون محكوماً بجريمة مخلة بالشرف والأخلاق والآداب العامة.
ولا شك أن هناك التزامات تقع على عاتق المحامي تجاه من يمثله، وبعض هذه الالتزامات مصدرها القانون، وقد يكون مصدرها العقد أو الاتفاق المبرم بينهما، ويقابل هذه الالتزامات حقوقاً يتمتع بها المحامي ورد النص عليها في بعض التشريعات، بالإضافة للقوانين التي تنظم مهنة المحاماة
