نظراً لعدم وجود سلطة عليا فوق سلطة الدول تتولى توزيع الإختصاص، والتنسيق بين النظم القضائية للدول المختلفة، فقد اضطلع كل مشروع بتحديد مجال ولاية محاكمة بالفصلفي المنازعات ذات العنصر الأجنبي، وهو ما ترتب عليه ان اتسمت قواعد الإختصاص القضائي الدولي في كل دولة بأنها قواعد وطنية أحادية الجانب، والدولة في قيامها بهذا التحديد لا تهتم بما إذا كان الإختصاص بالفصل في ذات النزاع الذي أقرت إدخاله في مجال اختصاص محاكمها يرتبط بدولة أخرى، ومن ثم يمكن أن يدخل في اختصاص محاكم هذه الدولة من عدمه.
كما قد يحدث من ناحية أخرى ان يقوم شخص برفع دعواه أمام قضاء دولة معينة، ثم يتبين له أن الحكم في هذه الدعوي لن يكون لصالحه، فيقوم برفع ذات الدعوى أمام محاكم دولة أخرى يتوقع أن تصدر حكماً لصالحه، أو حتى بغية إطالة أمد النزاع والإضرار بخصمه، وإزاء هذا الوضع يثار التساؤل الآتي: هل تستمر محاكم كل دولة من الدولتين المرفوع إليهما النزاع في نظر الدعوى، وتقطع الشوط إلى نهايته حتى إصدار حكم في الدعوى المرفوعة أمامها دونما اعتبار لقيام ذات النزاع امام محاكم الدولة الأخرى؟. أم أنه يمكن الأخذ بالدفع بالإحالة لقيام ذات النزاع امام محاكم الدولة الأخرى، لتلافي ما ينجم عن هذا الوضع من أضرار؟ لقد كان هذا التساؤل هو الدافع وراء اختيار هذه المسألة موضوعاً لهذه الدراسة، وعلى ذلك ستكون الدراسة على النحو التالي: (مبحث تمهيدي: ماهية الدفع بالإحالة وتمييزه عن غيره من أسباب الإحالة، الباب الأول: الدفع بالإحالة في النظم القانونية والاتفاقيات الدولية، الباب الثاني: النظام القانوني للدفة بالإحالة).
