يظهر لنا أن هناك توازناً عقدياً عند تطبيق المادة 747 من القانون المدنى التى جعلت الأقساط مقابلاً لمبلغ التأمين، بينما يختل هذا التوازن عن تطبيق المادة 751 من القانون المدنى التى تحدثت عن التعويض عند دفع مبلغ يقابل ما لحق المستأمن من ضرر وما تبعه من توسع الفقه فى مفهوم الصفة التعويضية، وهدفنا من تلك الدراسة أن نبحث عن وسيلة لتحقيق هذا التوازن عن طريق التقريب بين أحكام نوعى التأمين على الأشخاص ومن الأضرار، ولتحقيق ما نبتغيه سنقوم بإبراز مدى عدالة التأمين على الأشخاص.
ولتحقيق ذلك الهدف سنقوم بدراسة النتائج المترتبة على الصفة التعويضية لتأمين الأضرار، ثم سنعالج عيوب كل نتيجة بهدف إزالة الفوارق بين نوعى التأمين -التأمين على الأشخاص والتأمين من الأضرار- لمحاولة إقامة التوازن فى العلاقة العقدية بين المؤمن والمستأمن، ولذلك سنخصص لكل نتيجة مبحثاً مستقلاً نعرض فيه الآراء الفقهية والقضائية بصددها، وما يترتب عليها من إختلال فى التوازن العقدى، وكيفية علاج ما يترتب عليها من نتائج.
ولذلك سنقسم دراستنا للمباحث الآتية: مبحث تمهيدى: نتناول فيه مبررات التفرقة بين التأمين من الأضرار والتأمين على الأشخاص، المبحث الأول: أهمية عنصر الضرر فى الأمين من الأضرار، المبحث الثانى: ضرورة تناسب التعويض مع الضرر فى التأمين من الأضرار، المبحث الثالث: لا مجال لإعمال تأمين مغالى فيه فى التأمين من الأضرار، المبحث الرابع: تعدد عقود التأمين، المبحث الخامس: عدم تحديد مبلغ التأمين، المبحث السادس: الجمع بين مبلغ التأمين والتعويض، المبحث السابع: ضرورة توافر المصلحة الإقتصادية فى التأمين من الأضرار، المبحث الثامن: الوضع المترتب على عدم وفاء المستأمن لإفلتزامه بدفع قسط التأمين، المبحث التاسع: إخطار المؤمن بوقوع الحادث المؤمن ضده (جزاء السقوط).
