الباب الثاني: التفريق بواسطة القضاء. وفيه تمهيد وثلاثة فصول،
التمهيد: شرعية اللجوء إلى القضاء فى باب الطلاق.
الفصل الأول: التطليق لعدم الإنفاق في الفقه والقضاء.
الفصل الثانى: التطليف للضرر فى الفقه والقضاء.
الفصل الثالث: فرقة الخلع بين التراضى والتقاضي فى الفقه والقضاء
الخاتمة وفيها عرض لأهم النتائج والتوصيات.
