إن موضوع الحماية القانونية للعمالة الوافدة او الأجنبية تحتل مكانة رفيعة في الدول كافة في تشريعاتها العمالية المقارنة، وأيضاً على الصعيد الدولي فإن مساحة الإهتمام القانون الدولي بالعمالة الأجنبية نراها واضحة فيه، حيث يفرض حمايته عليهم من خلال الإتفاقيات الدولية التي تنظم قواعدها مسألة تشغيل العمال الأجانب، لأنّ العمال الأجانب يعتبرون من الفئات الضعيفة أو المستضعفة، مما يلزم تدخل قواعد القانون الدولي لحمايتهم وإلزام الدول التي المستضعفة، مما يلزم تدخل قواعد القانون الدولي لحمايتهم وإلزام الدول التي يعملون لديها أن تكفل لهم المعاملة الحسنة واللائقة، ومن المنطقي أن تلك الأهمية التي تكتسبها مسألة حق العمال الأجانب بالعمل في الدول كافة تشريعاتها العمالية، وأيضاً على الصعيد الدولي يترتب عليها أهمية كبيرة في الدراسات القانونية المتعلقة بها في مختلف الدول وذلك عن طريق بيان ما هو المتعلق بها في الإطار الدولي وفي الإطار الداخلي، من أجل توجيه المشرع إلى الأخذ بأفضل الحلول التي تتناسب مع ظروف المجتمع وتحقق مصالح الدولة، وفي نفس الوقت لا تتعارض مع أحكام القانون الدولي.
وتبرز أهمية الدراسة من الناحيتين النظرية والعملية: فمن الناحية النظرية، تتجلى أهمية هذه الدراسة من كونها موضوعاً مرناً ونسبياً يساعدنا على سرعة الإستجابة للتغيرات التي تحصل في المجتمع، إلا أن هدف الموضوع الثابت هو تحقيق العدالة الإجتماعية.
أما من الناحية العملية، فإن حقوق العمال الأجانب لم تتحدد معالمها في القانون بصورة مباشرة، أي ليس هناك حقوق ثابتة، إنما هذه الحقوق تختلف من منطقة لأخرى أو دولة دون أخرى، فالعمال الأجانب الذي يعيشون في الدول العربية، يتمتعون بحقوق تكون في بعض الدول أكثر من حقوق العمال الوطنيين، مثال ذلك الإمتيازات التي تعطى للشركات المتعددة الجنسية، التي يتمتع من خلالها العمال الأجانب بحقوق كبيرة.
