من الثابت أن الحماية الحقيقية لحقوق الإنسان تبدأ من النظام القانونى الداخلى، أى أنها تتم أولا بواسطة القانون الوطنى والأجهزة والمؤسسات الوطنية للدولة، فإذا فشلت هذه المؤسسات الوطنية فى حماية حقوق الإنسان، هنا يأتى دور المؤسسات والهيئات الدولية للقيام بتلك المهمة، ويكون باب اللجوء اليها لحماية حقوق الإنسان قد صار مفتوحا.
وانطلاقاً من هذه الحقيقة فقد خصصت هذه الدراسة لتناول الضمانات أو الآليات القانونية الوطنية والعالمية المطبقة لحماية حقوق الإنسان وحرياته الأساسية، وقد قسمت هذه الدراسة الى مقدمة وفصل تمهيدى تناولت فيه أهم الوثائق العالمية الخاصة بحماية حقوق الإنسان والتى تشكل فى الوقت الحالى ما يعرف بالميثاق العالمى لحقوق الإنسان.
أما الفصل الأول، فقد تناولت من خلاله دور أجهزة الأمم المتحدة فى حماية حقوق الإنسان على الصعيد العالمى، وأما الفصل الثانى، فقد تناولت فيه دور أجهزة الرقابة الدولية المنبثقة عن الاتفاقيات الدولية لحقوق الإنسان، وأما الفصل الثالث، فقد خصصته لتناول دور المنظمات الدولية المتخصصة فى حماية حقوق الإنسان، وأما الفصل الرابع، فقد تناولت من خلاله دور المنظمات الدولية غير الحكومية فى حماية حقوق الإنسان، أما الفصل الخامس والأخير، فقد خصصته لدراسة الآليات أو الضمانات القانونية لحماية حقوق الإنسان فى النظام القانونى المصرى.
