تأكيداً لحماية الحرية الشخصية فقد تدخل المشروع فى تعديل الأخير لقانون الإجراءات الجنائية, بالنص على بدائل للحبس الإحتياطى, وتقرير حق المحبوس إحتياطياً فى التعويض الأدبى بنشر كل حكم بات ببراءة من سبق حبسه إحتياطياً, وكذلك كل أمر صادر بألا وجه لإقامة الدعوى الجنائية قبله, أما التعويض المادى عن الحبس الإحتياطى فى الحالتين المشار إليهما فى الفقرة السابقة فقد أشارت المادة (312 مكرر) إلى أنه سوف يصدر بها قانون خاص, وهو ما ندعو المشروع إلى الإسراع فى تقريره بتشريع مستقل لإستكمال منظومة إحترام حقوق الإنسان فى حلات الحبس الإحتياطى.
فى ضوء ما تقدم سوف نقسم الدراسة إلى ستة فصول على النحو التالى: الفصل الأول: ماهية الحبس الإحتياطى. الفصل الثانى: السلطة المختصة بالحبس الإحتياطى ومدته. الفصل الثالث: شروط الحبس الإحتياطى. الفصل الرابع: الضمانات الخاصة بتنفيذ الأمر بالحبس الإحتياطى. الفصل الخامس: الإفراج المؤقت. الفصل السادس: الرقابة القضائية على الأمر بالحبس الإحتياطى. وأخيراً ننهى الدراسة بخاتمة لكل موضوعاتها مع التركيز فيها على أهم الملامح والنتائج الأساسية التى أسفرت عنها, والتوصيات التى نقترح الأخد بها.
