لم تحظ الكفالة العينية باهتمام الفقه فى مصر، على كثرة ما كتب فى التأمينات الشخصية والعينية، فلم نجد من خصص لها دراسة مستقلة، ما فى فرنسا، فقد لفتت هذه الفكرة انتباه بعض الباحثين القدامى الذين رأوها جديرة بالبحث، فأفردوا لها دراسة مستقلة، نشرت فى أواخر القرن الماضى، لكنها لم تلبث طواها النسيان من جديد، ولعل مبعث عدم الاهتمام الفقهى بهذه الفكرة، هو الاعتقاد بأنها ليست إن جاز هذا التشبيه- إلا حاصل جمع عناصر معروفه تماما، هى الكفالة والرهن، ومن ثم فلن يكون فيها ما يغرى على تكريس دراسة مستقلة خاصة بها.
ولما كان هذا الاعتقاد غير واقعى، فى الحقيقة إلى حد كبير، وكانت الكفالة العينية قد ظلت- بسببه- فكرة يكتنفها الكثير من الغموض، وكان المشروع؟، سواء فى صمر أم فى فرنسا، قد تجاهل هو الآخر تنظيمها تنظيما خاصا متكاملا (الله إلا ذلك القدر الذى سبقت الاشارة إليه من القوانين الفرنسية المنظمة لنواحى معينة)، حين أنها نظام أخذ استعامله فى الشيوع فى الوقت الحاضر، فقد رأينا اختيار هذا النوع الخاص من التأمينات، ليكون موضوعاً لهذا البحث.
