يعتبر الشيك أداة وفاء يقوم مقام النقود فى المعاملات ويستحق الدفع بمجرد الإطلاع. أى يقصد الساحب من إصدار الشيك وتسليمه للمستفيد إلى الوفاء بدين عليه فى مواجهة المستفيد أى بدلاً من الوفاء بالدين نقدأً، يتم تسويته عن طريق الشيك. ويترتب على استيفاء قيمة الشيك من المسحوب عليه براءة ذمة الساحب من الدين تلك هى وظيفة الشيك، أنه اداة وفاء. من هنا يجب أن تحظى هذه الدراسة فى رأينا بأهمية كبيرة خاصة فى مصر، بعد أن تفاقمت ظاهرة استخدام الشيك كأداة ضمان، وأصبحت بالفعل تهدد وتهدر القمية القانونية والإقتصادية للشيك باعتباره أداة وفاء وبديلا للنقود . وبالنتيجة أدى ذلك غلى زيادة جرائم الشيكات، وخاصة جريمة إصدار شيك بدون رصيد. الأمر الذى أثقل كاهل المحاكم الجنائية وسلطات الاتهام . وذلك الكتاب هو دراسة مقارنة لتلك القضية الهامة بينها فى القانون المصرى والقانون الفرنسى.
